1. Acceptance of Terms
By accessing or using our website or any Fortapura chatbot or related service (collectively, the “Services”), you agree to these Terms of Service (“Terms”). If you do not agree, please discontinue use immediately.
2. About Fortapura
Fortapura Limited develops and provides AI-powered chatbots to assist roofing companies with customer enquiries and service management. Our Services are intended for business use only.
3. Free Trial & Subscription
Fortapura may offer a one-month free trial of the chatbot platform to a limited number of customers (up to four). Unless cancelled at least 14 days before the end of the free trial, your subscription will automatically renew into a paid monthly plan at the agreed monthly price + VAT. We reserve the right to amend pricing or features with reasonable notice.
4. Accounts and Access
You must create an account to access certain features. You are responsible for safeguarding login credentials and for all activities under your account.
5. Permitted Use
You may use the Services only for lawful business purposes and in compliance with our Acceptable Use Policy. You may not:
- Misuse, interfere with, or attempt to hack the Services.
- Use the chatbot to send spam, offensive, or illegal material.
- Copy, decompile, or reverse-engineer Fortapura software.
6. Service Availability
We aim for at least 99% uptime excluding scheduled maintenance. Fortapura is not liable for downtime caused by third-party providers (e.g. Render or OpenAI).
7. Intellectual Property
All intellectual property in our website, chatbot platform, AI models, software, and materials remains the property of Fortapura Limited or its licensors. You receive only a limited, non-exclusive licence to use the Services during your subscription.
8. Data Protection
We process data according to our Privacy Policy. Where you use our chatbots for your customers, you act as Data Controller and Fortapura acts as Data Processor under the UK GDPR and Data Protection Act 2018.
9. Payment & Cancellation
Subscription fees are due monthly in advance. Cancellations require at least 14 days’ written notice before the next billing date. Fees are non-refundable except where required by law.
10. Disclaimers
The Services are provided “as is” and “as available.” Fortapura does not guarantee that the chatbot’s outputs will be error-free or suitable for every purpose.
11. Limitation of Liability
To the extent permitted by law, Fortapura’s total liability shall not exceed the amount you paid in the preceding 12 months. We are not liable for indirect or consequential losses (including loss of profit, data, or goodwill).
12. Indemnity
You agree to indemnify Fortapura against any claim arising from your misuse of the Services or breach of these Terms.
13. Termination
We may suspend or terminate your account for breach of these Terms or non-payment. On termination, your right to use the Services immediately ends.
14. Changes to These Terms
We may update these Terms periodically. Updates take effect when posted on our website.
15. Governing Law
These Terms are governed by the laws of England and Wales, and disputes shall be subject to the exclusive jurisdiction of its courts.
